The EU does not regulate "AI" as a monolith. It regulates platforms that reach enough Europeans to move elections, markets, and childhood attention spans.

That distinction just got sharper. EU regulators plan to classify OpenAI's ChatGPT and Roblox as very large online platforms (VLOPs) under the bloc's strictest digital rules, according to Bloomberg reporting cited in The Rundown Tech digest.

What VLOP status actually means

The Digital Services Act (DSA) created a tiered system. Once you cross roughly 45 million monthly active users in the EU, you are not a normal platform anymore.

Why ChatGPT designation matters for builders

  1. Map MAU by member state. The 45M threshold is EU-wide, but member states enforce.
  2. Write a systemic risk register even pre-VLOP. Migration is easier than retrofit.
  3. Separate child accounts with auditable defaults. Roblox and ChatGPT both face minor safety scrutiny.
  4. Instrument appeals and takedowns for synthetic outputs, not just user posts.
  5. Budget for external audits as opex, not a one-time legal project.
